We are committed to making the dispute management process as seamless and effective as possible. Our team will guide you through each step, ensuring clarity and support:

 

For Unaccepted Investors: We handle these disputes by treating them as refunds (chargebacks), simplifying the process and saving you time and effort. This approach minimizes operational complexity while keeping your raise on track.

 

For Accepted Investors: Our team takes a strategic approach to contesting disputes, utilizing readily available evidence (e.g., a signed subscription agreement) to strengthen your case. We will notify you promptly when a dispute arises and outline a clear timeline for action. You will have the opportunity to engage directly with the investor to resolve the dispute and to provide us with any additional relevant evidence before we submit the case on your behalf.

 

Ongoing Support: We’ll keep you informed throughout the process, from submission of evidence to final resolution, which typically takes up to three months. Our team is here to answer questions, provide guidance, and help you manage any outcomes effectively.

 

Outcome: If the dispute is won, the investors transaction will remain in your account and the investor will remain in your raise. If the dispute is lost and a chargeback occurs, the payment is clawed back from your account. Your company retains the right to pursue legal recourse against the investor, particularly if shares were issued based on the initial payment.

 

Managing Financial Risk with Holdbacks

To mitigate potential risks from chargebacks, DealMaker maintains a holdback (generally 5% for 90 days) from all accepted investments. This ensures that there are sufficient funds available to cover any chargebacks without impacting your operating account. While rare, if disputes exceed the holdback balance, your operating account will be debited to cover the shortfall.
